THE AGREEMENT: The use of this website and services on this website provided by KAWON ย (referred to as “Website”) are subject to the following Terms & Conditions, all parts, and sub-parts of which are specifically incorporated by reference here. This Agreement shall govern the use of all pages on this website (hereinafter collectively referred to as “Website”) and any services provided by or on this Website (“Services”).

ASSENT & ACCEPTANCE

PLEASE READย THESE TERMS OF USE, OUR PRIVACY POLICY, AND ALL APPLICABLE SUPPLEMENTAL TERMS (COLLECTIVELY, THE “TERMS”) CAREFULLY, AS THEY CONTAIN TERMS AND CONDITIONS THAT IMPACT YOUR RIGHTS, OBLIGATIONS AND REMEDIES IN CONNECTION WITH YOUR USE OF THE SERVICES AND CONTENT. FOR EXAMPLE, THE TERMS INCLUDE:

  • YOUR OBLIGATION TO COMPLY WITH ALL APPLICABLE LAWS AND REGULATIONS.
  • LIMITATIONS OF OUR LIABILITY TO YOU; AND
  • A REQUIREMENT THAT YOU PURSUE CLAIMS OR SEEK RELIEF AGAINST US (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS, RATHER THAN AS A PARTICIPANT IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

YOUR ACCESS TO AND USE OF THE SERVICES IS CONDITIONED ON YOUR ACCEPTANCE OF AND COMPLIANCE WITH ALL APPLICABLE TERMS. If you do not agree to these Terms or our Privacy Policy, then please cease using the Services immediately. We reserve the right to change these Terms at any time (see โ€œChanges to these Termsโ€ below.) Consequences of Non-Compliance

Your failure to comply with the Terms may result in the suspension or termination of your account and/or access to the Services and may subject you to civil and criminal penalties.

SERVICE

  • The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit staff. You may use, print, and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site and if you do or if you perform any other unauthorized processing of information on the site it shall be deemed a material breach of these terms and conditions which, in the case of a Customer, shall entitle us to terminate the Services immediately on notice in writing.
  • We expect basic courtesy from all Jobseekers whilst using our Site and/or Services. By accessing the Site and/or using the Services, you agree that you will not upload, post or transmit through the Site, anything that (a) violates or infringes in any way upon the rights of others, including any statements which may defame, harass, stalk or threaten others; (b) you know to be false, misleading or inaccurate; (c) contains blatant expressions of bigotry, racism, racially or ethnically offensive content, hate speech, abusiveness, vulgarity or profanity; (d) contains or advocates pornography or sexually explicit content, pedophilia, incest, bestiality, or that is otherwise obscene or lewd; (e) violates any law or advocates or provides instruction on dangerous, illegal, or predatory acts, or discusses illegal activities with the intent to commit them; (f) advocates violent behavior; or (g) poses, in our sole opinion, a threat to personal or public safety.
  • Further, we reserve the right to suspend provision of the Services to you in circumstances where we reasonably believe that you have performed any unauthorized processing of information. In respect of any personal data accessed or otherwise processed by a Customer because of access to the site or the Services, the Customer agrees that it shall be the sole data controller of such personal data for the purposes of the Data Protection Act 2018 and, as such, shall be solely responsible for its processing.
  • All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to us or its third-party suppliers. Use of the site does not give you any proprietary rights in such materials.

YOUR ACCOUNT

Certain Services will only be available as part of an account on the Site.

If you enter into an agreement for an account, you can use additional Services as described hereinafter

SAVED JOBS

You can save job ads that you have viewed, e.g., by bookmarking them or by clicking the respective button in the job ad. You will then be able to access such saved listings in your account.

  • YOUR PROFILE

You can create a CV-profile (โ€œProfileโ€) within your account, which will consist of various CV related pieces of information as well as attachments provided by you. It will also keep a record of your activity on our Platforms. You have several options when deciding how much of this information recruiters can see. The default when you sign up is for recruiters to be able to see your profile. This includes your CV and your โ€œLast Activeโ€ date (see below for more information on this). You can change the visibility of your profile at any time.

We will also share your application history (jobs you have applied for and when you applied for them) unless you tell us not to. You can change this at any time.

ADDITIONAL FUNCTIONS FOR JOB ALERTS

In your Account you can manage the โ€œJobs by emailโ€ settings, i.e., the criteria used to match your job alerts. We also send โ€œInstant job matchโ€ job alerts based on your search behavior and your job inventory changing. You can at any time deactivate โ€œJobs by emailโ€ or โ€œInstant job matchโ€.

ADDITIONAL TERMS APPLICABLE TO EMPLOYERS.

  • Employers are solely responsible for their postings on KAWONย  Site. KAWONย  is not to be an employer with respect to Your use of any KAWONย  Site and KAWONย  shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any KAWONย  Site.
  • You understand and acknowledge that if You cancel Your employer account or Your employer account is terminated, all Your account information from KAWON , including saved resumes, network contacts, and email mailing lists, will be marked as deleted in and may be deleted from KAWON ‘s databases. Information may continue to be available for some period because of delays in propagating such deletion through KAWON โ€™s web servers.
  • To protect our KAWONย  Users from commercial advertising or solicitation, KAWONย  reserves the right to restrict the number of e-mails which an employer may send to Users to a number which KAWONย  deems appropriate in its sole discretion. You shall use the KAWONย  Networking and Profiles in accordance with all applicable privacy and data protection laws.

JOB ADS

A Job ad may not contain:

  • Any hyperlinks, other than those specifically authorized by KAWON .
  • Misleading, unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined in KAWON โ€™s reasonable discretion.
  • The names, logos, or trademarks of unaffiliated companies other than those of your customer save where expressly agreed by KAWON .
  • The names of colleges, cities, states, towns, or countries that are unrelated to the posting.
  • More than one job or job description.
  • Inaccurate, false, or misleading information; and
  • Material or links to material that exploits people in a sexual, violent, or other manner, or solicits personal information from anyone under 18.

You may not use Your KAWONย  job ad or Profiles to:

  • Post jobs in a manner that does not comply with applicable local, national, and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property.
  • Post jobs that require citizenship of any country or lawful permanent residence in a country as a condition of employment, unless otherwise required to comply with law, regulations, executive order, or federal, state, or local government contract.
  • Post jobs that include any screening requirement or criterion in connection with a job ad where such requirement or criterion is not an actual and legal requirement of the posted job.
  • With respect to profiles, determine a consumer’s eligibility for: (i) credit or insurance for person, family, or household purposes; (ii) employment; or (iii) a government license of benefit.
  • Promote or advertise career fairs, job fairs, hiring events, conferences, seminars or open houses or any other event or meeting.
  • Post jobs or other advertisements for competitors of KAWONย  or post jobs or other content that contains links to any site competitive with KAWON .
  • Sell, promote, or advertise products or services.
  • Post any franchise, pyramid scheme, “club membership”, distributorship, multi-level marketing opportunity, or sales representative agency arrangement.
  • Post any business opportunity that requires an upfront or periodic payment or requires recruitment of other members, sub-distributors, or sub-agents.
  • Post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling.
  • Post jobs on any KAWONย  site for modeling, acting, talent or entertainment agencies or talent scouting positions.
  • Advertise sexual services or seek employees for jobs of a sexual nature.
  • Request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy.
  • Endorse a political party, political agenda, political position, or issue.
  • Promote a religion.
  • Except where allowed by applicable law, post jobs which require the applicant to provide information relating to his/her (i) racial or ethnic origin, (ii) political beliefs, (iii) philosophical or religious beliefs, (iv) membership of a trade union, (v) physical or mental health (including pregnancy status), (vi) sexual life, (vii) the commission of criminal offences or proceedings, or (vii) age.

KAWONย  reserves the right to remove any job ad or content from any KAWONย  Site, which in the reasonable exercise of KAWON โ€™s discretion, does not comply with the above Terms, or if any content is posted that KAWONย  believes is not in the best interest of KAWON .

If at any time during Your use of the KAWONย  Services, you made a misrepresentation of fact to KAWONย  or otherwise misled KAWONย  regarding the nature of Your business activities, KAWONย  will have grounds to terminate Your use of the KAWONย  Services.

ADDITIONAL TERMS APPLICABLE TO JOB SEEKERS.

  • When You register with any KAWONย  Site, you will be asked to login with LinkedIn, Google or another service or create an account and provide KAWONย  with certain information including, without limitation, name, zip code, career and education level and a valid email address (“Information”).
  • Any Profile You submit must be accurate and describe You, an individual person. The Profile requires standard fields to be completed and you may not include in these fields any telephone numbers, street addresses, or other means of contacting You, other than Your name.
  • You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on the KAWONย  Sites.
  • KAWONย  reserves the right to offer third party services and products to You based on the preferences that You identify in Your registration and at any time thereafter or you have agreed to receive, such offers may be made by KAWONย  or by third parties. Please see KAWON ‘s Privacy Policy, for further details regarding Your Information.
  • You understand and acknowledge that You have no ownership rights in Your account and that if You cancel Your KAWONย  account or Your KAWONย  account is terminated, all Your account information from KAWON , including resumes, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted in and may be deleted from KAWON ‘s databases and will be removed from any public area of the KAWONย  Sites. Information may continue to be available for some period because of delays in propagating such deletion through KAWON โ€™s web servers. In addition, third parties may retain saved copies of Your Information.

KAWONย  reserves the right to delete Your account and all Your Information after a significant duration of inactivity.

LICENSE TO USE WEBSITE

We may provide you with certain information because of your use of the Website or Services. Such information may include but is not limited to, documentation, data, or information developed by us, and other materials which may assist in your use of the Website or Services (“Our Materials”). Subject to this Agreement, we grant you a non-exclusive, limited, non-transferable, and revocable license to use Our Materials solely in connection with your use of the Website and Services. Our Materials may not be used for any other purpose, and this license terminates upon your cessation of use of the Website or Services or at the termination of this Agreement.

USER CONTENT

Content Responsibility.ย

When posting content to the website, please do not post content that:

  • sends repeated messages related to another user and/or makes derogatory or offensive comments about another individual or repeats prior posting of the same message under multiple emails or subjects.
  • Any submitted content that includes, but is not limited to the following, will be refused. If repeated violations occur, we reserve the right to cancel user access to the website without advanced notice.

INTELLECTUAL PROPERTY

You agree that the Website and all Services provided by us are the property of Turn point, including all copyrights, trademarks, trade secrets, patents, and other intellectual property (“Our IP”). You agree that we own all rights, title, and interest in and to the Our IP and that you will not use Our IP for any unlawful or infringing purpose.   • To publish or distribute any material that incites violence, hate, or discrimination towards any group.
  • To unlawfully gather information about others.

EMPLOYMENT AGENCIES AND EMPLOYMENT BUSINESS REGULATIONS 2003

Jobseekers and recruiters need to be aware that this job board operates as a venue only and does not introduce or supply jobseekers to recruiters (or vice versa). This means that we do not:

  • Obtain sufficient information for potential recruiters to select a suitable jobseeker for the position which the recruiter seeks to fill.
  • Obtain confirmation of the identity of a jobseeker or that they have the experience, training, qualifications, or authorization to work in the position to be filled or that they wish to undertake the role to be filled.
  • Take any steps to ensure the jobseeker and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the jobseeker to fulfil the position to be filled.
  • Take any steps to ensure that it would not be detrimental to the interests of the jobseeker or the recruiter for the jobseeker to fulfil the position to be fulfilled.
  • Give any indication to recruiters whether jobseekers are unsuitable (or suitable) for any position to be filled in any circumstances.
  • Propose jobseekers to recruiters or provide any information about them.
  • Take up any references in relation to a jobseeker; or,
  • Make any arrangements for accommodation of jobseekers.

REVERSE ENGINEERING & SECURITY

You agree not to undertake any of the following actions:

  1. a) Reverse engineer or attempt to reverse engineer or disassemble any code or software from or on the Website or Services.
  2. b) Violate the security of the Website or Services through any unauthorized access, circumvention of encryption or other security tools, data mining, or interference to any host, user, or network.

INDEMNIFICATION

You agree to defend and indemnify us and any of our affiliates (if applicable) and hold us harmless against any legal claims and demands, including reasonable attorney’s fees, which may arise from or relate to your use or misuse of the Website or Services, your breach of this Agreement, or your conduct or actions. SEVERABILITY: If any part or sub-part of this Agreement is held invalid or unenforceable by a court of law or competent arbitrator, the remaining parts and sub-parts will be enforced to the maximum extent possible. In such a condition, the remainder of this Agreement shall continue in full force.
  4. NO WAIVER: If we fail to enforce any provision of this Agreement, this shall not constitute a waiver of any future enforcement of that provision or any other provision. Waiver of any part or sub-part of this Agreement will not constitute a waiver of any other part or sub-part.
  5. HEADINGS FOR CONVENIENCE ONLY: Headings of parts and sub-parts under this Agreement are for convenience and organization, only. Headings shall not affect the meaning of any provisions of this Agreement.
  6. NO AGENCY, PARTNERSHIP, OR JOINT VENTURE: No agency, partnership, or joint venture has been created between the Parties because of this Agreement. No Party has any authority to bind the other to third parties.
  7. FORCE MAJEURE: We are not liable for any failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature, and natural disasters, and other acts which may be due to unforeseen circumstances, i.e., COVID-19!
  8. ELECTRONIC COMMUNICATIONS PERMITTED: Electronic communications are permitted to both Parties under this Agreement, including e-mail. For any questions or concerns, please use the contact us form on the website or email us.ย

GDPR-Customer data processing appendix:

Customer Data” means any personal data that KAWON processes on behalf of Customer via the Services, as more particularly described in this DPA.

Data Protection Laws” means all data protection laws and regulations applicable to a partyโ€™s processing of Customer Data under the Agreement, including, where applicable, EU Data Protection Law and Non-EU Data Protection Laws.

GDPR-EU data protection lawย ย 

โ€œEU Data Protection Lawโ€ means all data protection laws and regulations applicable to Europe, including (i) Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) (โ€œGDPRโ€œ); (ii) Directive 2002/58/EC concerning the processing of personal data and the protection of privacy in the electronic communications sector; (iii) applicable national implementations of (i) and (ii); and (iv) in respect of the United Kingdom (โ€œUKโ€œ) any applicable national legislation that replaces or converts in domestic law the GDPR or any other law relating to data and privacy as a consequence of the UK leaving the European Union.

โ€œEuropeโ€ means, for the purposes of this DPA, the European Union, the European Economic Area and/or their member states, Switzerland, and the United Kingdom.

โ€œNon-EU Data Protection Lawsโ€ means the California Consumer Privacy Act (โ€œCCPAโ€); the Canadian Personal Information Protection and Electronic Documents Act (โ€œPIPEDAโ€); and the Brazilian General Data Protection Law (โ€œLGPD โ€œ), Federal Law no. 13,709/2018.

โ€œSCCsโ€ means the standard contractual clauses for processors as approved by the European Commission or Swiss Federal Data Protection Authority (as applicable), which shall be applied only to transfers of Customer Data from the European Union.

โ€œSensitive Dataโ€ means (a) social security number, passport number, driverโ€™s license number, or similar identifier (or any portion thereof); (b) credit or debit card number (other than the truncated (last four digits) of a credit or debit card); (c) employment, financial, genetic, biometric or health information; (d) racial, ethnic, political or religious affiliation, trade union membership, or information about sexual life or sexual orientation; (e) account passwords; or (f) other information that falls within the definition of โ€œspecial categories of dataโ€ under applicable Data Protection Laws.

โ€œServices Dataโ€ means any data relating to the Customerโ€™s use, support and/or operation of the Services, including information relating to volumes, activity logs, frequencies, bounce rates or other information regarding emails and other communications Customer generates and sends using the Services.

  • Parties’ roles: If EU Data Protection Law or the LGPD applies to either party’s processing of Customer Data, the parties acknowledge and agree that concerning the processing of Customer Data, Customer is the controller and is a processor acting on behalf of Customer, as further described in Annex A (Details of Data Processing) of this DPA.
  • Purpose limitation: KAWON shall process Customer Data only following Customer’s documented lawful instructions as outlined in this DPA, as necessary to comply with applicable law, or as otherwise agreed in writing (“Permitted Purposes”). The parties agree that the agreement sets out the Customer’s complete and final instructions to KAWON concerning the processing of Customer Data, and processing outside the scope of these instructions (if any) shall require a prior written agreement between the parties.
  • Prohibited data. Customer will not provide (or cause to be provided) any Sensitive Data to KAWON for processing under the Agreement, and KAWON will have no liability whatsoever for Sensitive Data, whether in connection with a Security Incident or otherwise. For the avoidance of doubt, this DPA will not apply to Sensitive Data.
  • Customer compliance: Customer represents and warrants that (i) it has complied, and will continue to comply, with all applicable laws, including Data Protection Laws, in respect of its processing of Customer Data and any processing instructions it issues to KAWON; and (ii) it has provided, and will continue to provide, all notice and has obtained, and will continue to obtain, all consents and rights necessary under Data Protection Laws for KAWON ย  to process Customer Data for the purposes described in the agreement. Customer shall have sole responsibility for the accuracy, quality, and legality of Customer Data and how Customer acquired Customer data. Without prejudice to the generality of the foregoing, Customer agrees that it shall be responsible for complying with all laws (including Data Protection Laws) applicable to any emails or other content created, sent, or managed through the service, including those relating to obtaining consents (where required) to send emails, the content of the emails and its email deployment practices.
  • The lawfulness of Customer’s instructions: Customer will ensure that United Kingdom processing of the Customer Data by Customer’s instructions will not cause KAWON to violate any applicable law, regulation, or rule, including, without limitation, Data Protection Laws. KAWON shall promptly notify Customer in writing unless prohibited from doing so under EU Data Protection Laws if it becomes aware or believes that any data processing instruction from Customer violates the GDPR or any UK implementation of the GDPR.

Your Legal Rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data.

You may have the following rights: –

  1. Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  2. Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  3. Request deletion of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  4. Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  5. Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
